Q. What is the minimum wage in Kansas?

A. The Kansas minimum wage is $2.65 per hour.

Q. Who must be paid the Kansas minimum wage?

A. All employees not covered by the Federal Fair Labor Standard Act must be paid Kansas minimum wage. Contact Federal Wage and Hour at (913) 551-5721 to inquire about whether your company is covered by the Federal Fair Labor Standards Act.

Q. What is the Federal minimum wage?

A. The Federal minimum wage is $6.55 per hour
as of July 24, 2008.

Q. How often do I have to be paid?

A. Your employer must pay you at least once a month. Your employer must pay on regular paydays and inform you of paydays in advance.

Q. Can my employer change my rate of pay?

A. Yes, your employer can change your pay, but they must give you notice before they do it. Your employer can not change your rate of pay retroactively.

Q. Does an employer have to pay for all hours worked or services rendered?

A. Yes, if the employer has authorized you to work or accepts the benefit of your work.

Q. Is it legal to pay in cash?

A. Yes, but your employer must still withhold for taxes.

Q. Can my boss make me participate in direct deposit?

A. Unless you work for the federal government, your employer cannot make you participate in direct deposit. However, many employees find it is more convenient to be paid through direct deposit.

Q. What kind of information is my employer supposed to put on my pay stub?

Your employer is not required to put anything on your pay stub. However, if you request it, your employer must provide you with an itemized statement of deductions for each pay period.

Q. Can my employer hold my paycheck until I return my uniform(s), tools, pager, etc.?

A. No.

Q. Can my employer take money out of my wages to cover cash register shortages or damages to the employer's equipment/property?

A. No.

Q. If I am overpaid, can my employer deduct the amount of the overpayment from my paycheck?

A. Yes.

Q. Can an employer fine an employee and take it out of his or her paycheck?

A. No.

Q. Does my employer have to pay holiday pay?

A. The law does not require your employer to offer holiday pay, but many employers provide this as a benefit for their employees.

Q. Does my employer have to offer severance pay?

A. No, unless it is a stated company policy.

Q. If I quit or am fired, am I entitled to payment for my unused accrued vacation time?

A. Only if your employer has a policy or practice that employees will be paid for unused vacation time.
